This particular area of the Take Back Kentucky web site is devoted to what may well be the biggest fraud ever perpetrated upon the American people. Yes, we have the Federal reserve and other programs but this is probably the biggest. We have an economic system not authorized by the Constitution of the United States that can and does determine the economic capabilities of a town, state or region of the country based on lies and deceit. This fraud also is used to allegedly clean up our environment. It doesn’t! If nothing else it “permits” polluting legally. Yes, you read it right! You can get what amounts to a permit to pollute! Can’t you see the water becoming cleaner, the trees greener and your health improving? Richard Lewis of Louisville, KY is one of, if not the most, knowledgeable people in the country on this issue. Richard will use this page to expose this fraud. Richard wants you to contact him with information or questions via phone or email. Richard will in turn post your question and the answer for the world to see. To contact Richard: email freepres@bellsouth.net phone 502-454-3707

Reasons for Environmental Laws and Regulations

By Richard Lewis

Protecting the Environment

Protecting Public Health and Safety

Providing an Environment That Will Allow for Future Economic Expansion

Most citizens have heard about or would agree with the reasons stated above.

However, have they heard about or would they agree with the reasons given below?

Allowing a corporation to sell emission credits / pollution allowances to another county, state or nation thereby limiting future economic expansion in the local community from which they had been sold?

Giving a corporation control of a local community’s economic future after it has closed shop or left town?

Funding a vastly expanded United Nations

Forty years ago there was a shortage of manufactures selling industrial equipment to clean industrial pollution emissions. “Pollution Credits” were originally created as financial incentives to encourage businesses to develop or purchase equipment to clean our air and water. Times have changed

The EPA has real regulatory teeth and vendors are now competing to provide industry the equipment it needs to comply with EPA standards.

Pollution credits accomplished their original purpose, but they have been allowed to transform into a New Kind of Money a Universal Corporate Currency that has not been subject to public audit or scrutiny.

When a corporation moves out of your town or city it may retain ownership of its pollution credits (credits which an existing industry may need to expand or a new industry needs to move in and replace lost jobs). Private corporate ownership of pollution credits can give a corporation control of a local community’s economic future even after the company has shut down and left many local workers unemployed.

I encourage anyone reading this article to visit the Louisville, KY Business First website and read the article about how Ford Motor Company purchased pollution credits from the Phillip Morris Plant after it had ended their operations in Louisville. (Please note Ford motor company would not say what they paid Phillip Morris for pollution credits that they needed to expand truck production.)

What would have happened if Phillip Morris had refused to sell its credits when their plant left Louisville?

If Phillip Morris had dragged its feet longer would Ford Motor Company have expanded production in another state?

Governor Patton made it clear that he would not take an active part in influencing Phillip Morris’s decision regarding the sale of pollution credits!

Would Kentucky be blackballed if it became the first state to strong-arm a corporation to sell or return its credits to a local community?

Would injury be added to insult if Kentucky taxpayers were forced to ante up to purchase pollution credits needed to replace lost employment opportunity?

Corporations certainly have a right to close, leave town, or even move overseas but why should any corporation be allowed to own “financial instruments” whereby they exercise control over the economic future of a local community after they have closed or moved?

Sequestration credits (pollution credits) are already being traded across international borders. Those trades represent more than a transfer of money or emission credits. Their market value is million and billions of dollars worldwide. They represent an agreement whereby the corporation or individual selling those credits controls or possibly restricts the future economic growth of the town, city, state and/or country.

All legitimate lawful government is based on the informed consent of its people. The people of the United States and the Commonwealth of Kentucky have not given lawmakers their consent to create financial instruments whereby economic decision making is transferred from elected leaders to global corporations or individual citizens acting in their own interest.

Please find below letters from my Congressman Anne Northup and from Sen. Dan Seum Kentucky Senate Majority Whip addressed to Secretary LaJuana Wilcher at the Kentucky Environment & Public Protection Cabinet. The letters ask pointed questions about accountability and use of pollution credits. To date, I have not received any answers to those questions. Please note one of the letters is dated January 18, 2006.

Isn’t it high time that these questions are answered and that the citizens are informed about these important matters? My hope is that you will educate yourself and others and begin to ask these very important questions of your elected representatives. Do you trust corporate control and lax public oversight of these very valuable and little known assets that have been created by our government? Would it help to know that Enron was a large broker of pollution credits?

I intend to get the answers and I intend to work to demand clear policies that prevent corporations from taking control of economic policy decisions via emission credits.

Please take the time to read the letters below.

A lot will be happening in Washington DC shortly and the KMA is planning a trip to visit our Congressional Delegation July 28th – 30th. If you have some time off work and can go to DC for a few days please let me know. We would be glad to have you. Just send me an email to president@kmakba.com and I can give you some more details about the trip. We will be there to discuss HR 1587 concerning the youth ATV’s and dirt bikes, EPA emission programs under consideration, smart growth bills currently up for consideration which may limit where or when you could ride, HR 1207 audit the fed bill and more.

There are lots of bills up for consideration which can have many negative impacts on motorcycles. The main one being discussed is the new health care regime that is being pushed by the Obama administration. Just on the surface it appears to be a bad idea to me in that what government run program have you ever seen work well? Just ask the folks who go to the VA for their health care how well they like it and how much red tape they go through to get it. Just consider this, the federal government took over a whorehouse in Nevada several years back due to nonpayment of taxes. They tried to run it and shortly after it went bankrupt. If they can’t even make money and run a whorehouse effectively then how are they gonna run our hospitals.

But that is just the surface of the issue. We have already seen in the hearings for this program that the feds think they can save $50 per person per year for every pound they were to lose for those that are overweight. If the government is in charge of your health care will they then be able to tell you, we will not pay all or part of the costs unless you lose 10 pounds or quit smoking or drinking? Will they be able to say you are not covered since you were not wearing a helmet when that other driver t-boned you from the side street. Will they be able to say you are not covered because you weren’t wearing a seat belt or speeding or whatever else they want to make up? Will they limit your healthcare if you go to the drag strip and race on the weekends or ride horseback, ski, fly your own small plane or other hobby? We have already seen the start of this in the private sector and have been trying to address it for some time now. The whole social burden theory plays right into this for whichever group they may wish to attack whether it be motorcycles, horseback riders, smokers, drinkers, overweight people, etc…. I personally am going to ask my Congressmen to oppose this program and would like to hear from you if the KMA as an organization should take up banner as well and oppose it also. There may be benefits but in my personal opinion the loss of my freedoms and the coercion that can be imposed by the federal government far outweigh any benefits I can see. The more the feds take over industry after industry the farther down the path of socialism we go. Please let me know what you think the KMA should do on this issue.

Another resolution you may find interesting HJRes 5 would abolish the 22nd amendment which limits the President of the US to just 2 terms. It was introduced by a Representative from New York Rep. SERRANO.

Proposing an amendment to the Constitution of the United States to repeal the twenty-second article of amendment, thereby removing the limitation on the number of terms an individual… (Introduced in House)

I receive a lot of updates from Mark Lerner of the Stop REAL ID Coalition that have a lot of good information in them; however, sometimes it is easier for you guys if I just summarize it for you.

Mark did attend the hearing on the PASS ACT today, in which he was not allowed to testify.

There was no opposition to the PASS ACT except for those that thought it was not strong enough or they gave lip service concern over privacy.

In the past week and a half lies have been coming out of Washington D.C. to callers over this issue.

Lie 1: It repeals REAL ID.

Lie 2: It does not contain biometrics

Lie 3: There will be testimony allowed in opposition of the bill

Lie 4: They had never heard of Mark Lerner or the Stop REAL ID Coalition. There had already been previous meeting between staffers, aids, Senators and Mark.

All these lies have been refuted.

So Mark took the opportunity to have dissuasions with as many people as possible on this matter.

Other opposed organizations in attendance were EPIC and 5-11 whom also was not allowed to testify.

This hearing was billed as a revaluation of REAL ID but it was more of an affirmation and the further agreement that the Federal Government should interfere in State Sovereignty and set standards for drivers licenses AKA your ID because that is what it is really all about, who are you and everything about you, right down to your body.

L-1 Identity Solutions, the Corporation that stands to gain from this acted as if they owned the place. But our Coalition is hopeful this will change as things said to be impossible in the past have happened in regard to this issue like the ACLU and ACLJ coming together and people from both sides of the aisle once they see all the facts coming to the conclusion that this is a bad idea if they have any patriotic, liberty minded sense left in them. More people are becoming aware of REAL ID.

Mark was informed a written testimony would be accepted; however, that is viewed as a waste of precious time, it will not be read and it will garner little to most likely no attention by the media unlike an actual testimony in a hearing.

There was NOT A VOTE TODAY and there are to be more hearings. So, there is still a chance Mark could testify.

We need to make calls to Sen. Lieberman at 202-224-4041and the Homeland Security and Governmental Affairs line at 202-224-2627

Ask that Mark Lerner from the Stop REAL ID Coalition be allowed to testify in opposing to S 1261 the PASS ACT.

* REAL ID/PASS ID IS
* A VIOLATION OF STATE SOVERIGNTY
* AN UNFUNDED MANDATE
* A VIOLATION OF THE 1ST, & 4TH AMENDMENTS
* HAS BIOMETRICS
* WILL LEAD TO A SURVIELANCE SOCIETY
* IS INTERNATIONAL AS A UN AGENCY WILL REGULATE THIS.

FOR MORE INFORMATION ON REAL ID/PASS ID GO TO: WWW.STOPREALIDCOALITION.COM

To check out the testimony that was given today go to: http://hsgac.senate.gov/public/index.cfm?FuseAction=Hearings.Hearing&Hearing_ID=3d9a52cd-c442-4dee-9a1f-b02ed3b38000

I know this is not an easy issue to understand and may not seem important because until Sunday by and large the media was ignoring it except for a mention by Charles Key of Oklahoma, the author of the popularized Sovereignty Resolution on Huckabee about a month ago as they discussed it.

FAILURE IS NOT AN OPTION!!!!!!

Conference Information

Those who have attended our Conferences in the past know it is a tradition to present to our attendees the leaders and speakers who are at the forefront of the issues that threaten our freedoms. This year will be no different, and promises to be even better!

The Conference this year will include discussions on international policies and treaties like the U.N.’s Agenda 21 and its policy of Sustainable Development – a top down control that stamps out private property, limited government, and free enterprise. Other topics will include the assault on Health Freedom; the threat of an International ID system through Real ID; the scam called Climate Change; the new state Sovereignty movement; how private property can end poverty; gun rights; doing away with the Federal Reserve; the real reasons children aren’t learning in the public classrooms; how the Trans Texas Corridor is being defeated on the local level; and much, much more.
There will also be training sessions, breakout sessions, and opportunities to interact with the speakers. And, you will not want to miss the Awards Banquet when the coveted “Freedom’s Heroes Award” is presented.

Some of the guest speakers and their topics that you will have an opportunity to hear at this Conference include:

U.S. House Committee Moves Surface Transportation Bill

The Motorcycle Riders Foundation (MRF) has learned that, with little pomp and even less circumstance, the Unites States House of Representatives subcommittee on Highways and Transit voice voted the Surface Transportation Bill on to the full House Transportation and Infrastructure Committee (HTIC). The 800-page bill lays out a plan for revamping the nation’s highway systems and safety programs not seen in the last few decades. The spending bill, which is yet to receive a number or name – and even more importantly a price tag – is mammoth.

The Highway Trust Fund (HTF) will be out of money 6 weeks before the fund was supposed to be tapped out. Future predictions for the HTF, which is funded through a national gas tax, are bleak. With more fuel-efficient cars and record-breaking gas prices, Americans have done the unthinkable the past few years – buy less gas. That conundrum will leave the HTF with about $250 billion to be generated over the next 6 years. Congressman Jim Oberstar, Chairman of the HTIC, wants to spend $500 billion. Talks between the House, Senate and White House have completely broken down. Oberstar would like to raise the gas tax, and both the Senate and the White House shot that down immediately. This stalemate will likely delay the bill significantly; some say well into 2012. At the same time, it could move quickly, but that’s not likely.

The bill does have some motorcycle-specific provisions, the lion’s share of which are very positive. The MRF has been meeting with the committee staff writing the bill for the past few years to ensure that motorcyclists benefit from the legislation. For the first time, the highway safety funds obligate a percentage that can only be used for motorcycle safety programs. Depending on the percentage (all financial details at this point are to be determined), the motorcycle safety community could see a huge infusion of federal cash.

There is one provision that the MRF will be aggressively working to remove. In one section of the bill, some rules are laid out for Public Private Partnerships (PPP). PPPs are stretches of toll road that a community leases to a private sector partner. The partner pays the leasing government up front and in turn gets to keep all the tolls for the length of the lease. The city of Chicago leased a toll road for 99 years to a private company for $1.8 billion in 2005. The provision of concern gives the private sector partner the power to request from the Secretary of Transportation a ban on motorcycles from the road. The private partner must certify that the presence of motorcycles is causing a safety hazard.

The Secretary must approve the request. Current law allows for the same situation, but gives the requesting power to the state agency, not a private for-profit corporation.

Public Private Partnerships have fallen out of favor with many municipalities and individuals, but this section is still of grave concern. It’s troubling to think that roads built with federal tax dollars could exclude motorcycles. Precedent has been set in our favor in the past; convincing Congress will be our task.

The MRF will keep you informed on the movement of the bill and of the motorcycle-specific provisions in the bill.

– And you could be forced to spend $13,000 of your own money toward this effort!

Tuesday, June 16, 2009

At long last, Teddy Kennedy has partially revealed the health care system he wants to foist on the whole country — and it isn’t pretty.

It won’t be pretty for your pocket book… OR FOR YOUR GUN RIGHTS!

But first, let us explain what TeddyCare is all about.

At the center of the plan is what’s called a “universal mandate.” What this means is that you — and virtually everyone in the country — will have to buy as much health insurance as the government demands, and that insurance plan will actually have to be approved by the government.

If you work for a small business, the business will buy the insurance on your behalf. But you may be saddled with an enormous part of the cost. And, if the employer’s contribution is too large, you will be fired.

If you fail to buy TeddyCare, as the government orders you to do, the IRS will fine you, garnish your wages, put a lien on your house, and, ultimately, put you in prison.

How much will you have to spend on your TeddyCare insurance? Teddy’s not saying.

The portion of your paycheck that will have to be forked over to Teddy’s latest social experiment will be revealed ONLY AFTER THE MASSIVE HEALTH CARE BILL IS SIGNED INTO LAW.

This should set off alarm bells in your brain, because, for instance, the average family policy is currently $12,700. “So,” proclaims Teddy, “everyone’s going to get a subsidy to pay for this.” There’s going to be a “chicken in every pot,” and no one’s going to have to pay for it.

Yeah, right. If you’re a welfare mother, the government will pay for your TeddyCare, and it would pay for it — the first time — by taxing employer-provided health benefits of working Americans. But if you a “working Joe” your Kennedy-subsidy will be a microscopic fraction of the cost of your mandated TeddyCare insurance policy.

Okay, all of this sounds ominous… but why is this a gun issue?

The answer is that TeddyCare will allow radical left Health and Human Services Secretary Kathleen Sebelius to determine all of the fine print in every TeddyCare policy — which you will be required to buy under penalty of imprisonment.

Currently, as a result of the stimulus bill and a whole lot of other factors, the government is rapidly moving in the direction of computerizing all of your most confidential medical records and putting them into a federal database.

So remember when your son was asked by his pediatrician about your gun collection? That would be in the federal database.

Or remember when your wife told her gynecologist that she had regularly smoked marijuana ten years ago — thereby potentially barring both her and you from ever owning a gun again? That would be in the database.

Or if a military veteran complains to his psychiatrist that he’s had emotional stress since coming back to the States, that would be in the database.

Or remember when gramps was diagnosed with Alzheimer’s, thereby making him a “mental defective” who would have to relinquish his life-long gun collection? That’s in there too.

And, while we are dangerously close to allowing BATFE to troll all of that information, TeddyCare would allow Sebelius to put EVERYONE’S private data in a database with a stroke of a pen.

When we say “everyone,” we don’t mean quite everyone.

Teddy has conveniently excluded Washington bureaucrats from his TeddyCare mandate.

Also, Teddy and his friends in the media don’t want you to hear about the details until after the bill is passed. That’s why they’re trying to slam it through within the next month and a half before anyone’s had a chance to read or debate it.

In fact, the TeddyCare proposal is currently circulating around Capitol Hill without even a bill number.

ACTION: Urge your two U.S. Senators to oppose Sen. Ted Kennedy’s mandate that will result in the registration of all your gun information. Please use the Gun Owners Legislative Action Center to send your Senators the pre-written e-mail message below.

—– Pre-written letter —–

Dear Senator:

At long last, Teddy Kennedy has partially revealed the health care system he wants to foist on the whole country — and it isn’t pretty.

At the center of the TeddyCare plan is what’s called a “universal mandate.” What this means is that I — and virtually everyone in the country — will have to buy as much health insurance as the government demands, and that insurance plan will actually have to be approved by the government.

But this is not only an issue of individual freedom; it is a gun issue.

This is because Teddycare will allow radical left Health and Human Services Secretary Kathleen Sebelius to determine all of the fine print in every Teddycare policy — which Americans will be required to buy under penalty of imprisonment.

Currently, as a result of the stimulus bill and a whole lot of other factors, the government is rapidly moving in the direction of computerizing all of our most confidential medical records and putting them into a federal database.

So if a kid is asked by his pediatrician about his dad’s gun collection, that would be in the federal database.

Or if a wife told her gynecologist that she had regularly smoked marijuana ten years ago — thereby potentially barring both her and her husband from ever owning a gun again, that would be in the database.

Or if a military veteran complains to his psychiatrist that he’s had emotional stress since coming back from Iraq or Afghanistan, that would be in the database.

Or when gramps was diagnosed with Alzheimer’s, thereby making him a “mental defective” who would have to relinquish his life-long gun collection, that would be in there too.

And, while we are dangerously close to allowing BATFE to troll all of that information, TeddyCare would allow Sebelius to put EVERYONE’S private data in a database with a stroke of a pen.

You cannot imagine how angry I, my family, and my neighbors are about this most recent fraud scheme to cheat me out of perhaps over $10,000 for TeddyCare — and to violate my privacy in the process.

I insist that you oppose TeddyCare — immediately and loudly. Please do not try to shower me with propaganda about how a mandate on how I spend my own money is somehow good for me.

Sincerely,

By Eric Peters, Automotive Columnist
Now they’ll be fingerprinting us for jaywalking. Or “speeding.” Just about any (formerly minor) traffic violation.
Beginning in the once-fine state of Tennessee. Southerners, it appears, are becoming just as statist as the Yankee carpetbaggers they used to (rightly) despise.
Two bills have made their way through the rancid colon of the TN House and Senate, HB2220 and SB2153, respectively, that would “… authorize(s) use of fingerprints as (a) form of acknowledgement, in lieu of, or in addition to, a person’s signature for citations and certain other notices and documents.” (See http://www.capitol.tn.gov and type in the bill numbers.)
In plain language, when you get pulled over or stopped by a cop for some trivial reason such as doing 5 mph over the limit in a Radar Trap Zone, the cop — at his discretion — may compel you, the offender, to submit to being fingerprinted “in lieu of, or in addition to” your signature on the summons.
Tennessee’s tyranny is the first such action of its kind in these forcibly united States — and has aroused a popular groundswell of resentment and resistance. Understandably.
Fingerprinting starts with an “F” — because generally, the accepted practice has been that only felons, or those accused of committing felonies, get inked. Fingerprints go into a national criminal database, so that in the future it will be easier and simpler to track and identify the activities of felons.
But jaywalkers, U-turn bandits and speeders?
Hell, under TN’s new cornpone jackbootery, a person could be fingerprinted merely for spitting on the sidewalk, in violation of town ordinance Barney Fife 5, Section 3a.
It would be humorous, maybe a little bit, if it weren’t so obnoxious to common sense and civil liberties.
Anything government does always costs more than originally promised and this study is no exception. Initial funding was not nearly enough so the project has languished for lack of funds.

For example, the American Motorcyclist Association, one of the boondoggle’s chief cheerleaders, is dunning its members with a “Fuel the Fund” campaign. This article will demonstrate why “Fund the Fools” would be a more apt slogan.

Their website reveals that they are an amalgam of state-sponsored interests – three state universities, Oklahoma DOT, the Oklahoma Turnpike Authority, and several businesses that, like the Center itself, rely on state and federal money. Heaven help us if that is what passes for “independent” nowadays. And “well-respected”? Maybe by the interests involved, as in any mutual admiration society, but not by me, or probably not by you either after you read about their bogus methodology.

Some 123,000 motorcycles are involved in accidents yearly, yet only 900 accidents will be studied. How can anything realistic be derived from studying less than 1% of the total? Obviously, the results can be skewed if all involve speeding or all involve DUI or all involve ROW violations. If a variety of accidents are studied, how is it known if the variety is an accurate sample reflecting all types of accidents?

Some situations are similar but no two accidents are identical. All it takes is one variable to make a situation different. That one variable could be the fatal variable, and it could be something unmeasurable like the rider’ thoughts.

Any accident being studied will be investigated thoroughly. So thoroughly that the current cost estimate per accident is $10,000. Even allowing that as reasonable, nonsense dons the mask of science when, after investigating the accident, researchers then attempt to create what they term “controls”. Controls will be two other riders doing the same thing as the rider who crashed. Those riders will then be interviewed to determine why they did not crash (assuming they did not) and why the initial rider did crash.

This so-called “methodology” is absurd on the face of it and should set off anyone’s BS detector. No two riders are alike, and no two situations are the same. Thus, there is no “control”. A control in an experiment is an absolute to which something else can be compared. There is no absolute here and never will be as long as humans are involved.

For example, let’s say someone crashes because they are speeding in a turn but someone else speeds in the turn and makes it. What does this tell us? Only that one rider is better than another. But wait; even that is not true. Maybe the one who crashed had something go wrong, either with himself – his health, whatever – or with his machine. If the guy died or his machine got totaled beyond recognition, we may not ever know what exactly went wrong. And even if he lived, his assessment of what went wrong could be incorrect. Maybe the guy got distracted for a second by something other riders on the same route would not have to deal with – a personal problem, an attractive woman in a mini-skirt, who knows? So the cause may not have been speed at all – even if the rider was speeding.

The point is, there are too many unknowns and too many variables to quantify scientifically. These are people being studied, not robots. What we will have with this study is costly nonsense masquerading as science. And costly it is. Multiplying $10,000 per accident by 900 accidents equals $9 million. And this is now being called the bare minimum!

The vast amount of money wasted brings up another unfortunate point. The more this thing costs, the more it will be lauded with high-sounding words like “extensive”, “exhaustive” and “landmark”. Gullible fools impressed by those words, by large dollar amounts and names with PhD after them will think, “This is a multi-million dollar study done by experts. It must be right.” But it won’t be.
